  23. I managed to dig up the full text of the statute this weekend.  Other than
  24. hams and peace officers, it appears that permits are issued on a case by
  25. case basis by the BCA.  There also is no mention of confiscation; although,
  26. in the case of a misdemeanor I would expect that the scanner would be
  27. taken for evidence.

  34.   Subdivision 1.  (a) No person other than peace officers within the
  35. state, the members of the state patrol, and persons who hold an amateur
  36. radio license issued by the Federal Communications Commission, shall
  37. equip any motor vehicle with any radio equipment of combination of
  38. equipment, capable of receiving any radio signal, message, or
  39. information from any police emergency frequency, or install, use or
  40. possess the equipment in a motor vehicle without permission from the
  41. superintendent of the bureau upon a form prescribed by the
  42. superintendent.

  44. An amateur radio license holder is not entiltled to exercise the
  45. privilege granted by this paragraph if the license holder has been
  46. conviced in this state or elsewhere of a crime of violence, as defined
  47. in section 624.712, subdivision 5, unless ten years have elapsed since
  48. the person has been restored to civil rights or the sentence has
  49. expired, whichever occurs first, and during that time the person has not
  50. been convicted of any other crime of violence.

  52. For purposes of this section, "crime of violence" includes a crime in
  53. another state or jurisdiction that would have been a crime of violence
  54. if it had been committed in this state.

  56. Radio equipment installed, used, or possessed as permitted by this
  57. paragraph must be under the direct control of the license holder
  58. wherever it is used.
  59.  
  60.    (b) Except as provided in paragraph (c), any person who is convicted
  61. of a violation of this subdivision shall, upon conviction for the first
  62. offense, be guilty of a misdemeanor, and for the second and subsequent
  63. offenses shall be guilty of a gross misdemeanor.

  65.    (c) An amateur radio license holder who exercises the privilege
  66. granted by paragraph (a) shall carry the amateur radio license in the
  67. motor vehicle at all times and shall present the license to a peace
  68. officer on request.  A violation of this paragraph is a petty
  69. misdemeanor.  A second or subsequent violation is a misdemeanor.

  71. Subd. 3.  The superintendent of the bureau shall, upon written
  72. application, issue a written permit, which shall be nontransferable, to
  73. a person, firm, or corporation showing good cause to use radio equipment
  74. capable of receiving a police emergency frequency, as a nesessity, in
  75. the lawful pursuit of a business, trade, or occupation.

  82. allow amateur radio operators to use equipment capable of receiving
  83. police emergency radio frequencies.
